Creative Commons Licences
A key tool of Creative Commons is legal licences to replace the traditional 'All Rights Reserved' model with 'Certain Rights Reserved' - while respecting the principles of copyright law. Creative Commons licences offer a diverse set of licence conditions - freedoms and restrictions. This allows the author to define for themselves the rules on which they want to share their work with others. Over the course of its ten years in operation, Creative Commons has established a robust global presence through its dedicated efforts to foster creativity and facilitate the legal access to cultural resources. Every Creative Commons license shares common elements, such as a commitment to upholding moral rights, while also allowing the licensor (or creator) to include additional conditions of their choice. Licence conditions are like building blocks - the rules set out by a licence are the result of putting two or three such conditions together. When using the licence, the creator always retains the copyright, while allowing others to copy and distribute, and may additionally specify whether their use may only take place under non-commercial conditions or restrict the creation of derivative works. A creator selecting a Creative Commons license needs to address two fundamental questions to determine the appropriate license terms: first, whether they permit commercial use of their works, and second, whether they allow the creation of derivative works, and if so, whether they require that those derivative works also be made available under the same license. The 'ShareAlike' condition is a mechanism to support free culture and the popularisation of free licences. Licences such as the GNU General Public License, used by many open source projects, operate on similar principles. Creative Commons licences do not infringe the freedoms that copyright law grants to all users under fair use and quotation rights. The use of licences makes it possible to explicitly define additional rights for users (licensees). The licensee must always comply with the terms and conditions of the licence, otherwise the licence automatically expires. This implies that the author and their rights must be accurately attributed on every copy of the work, and any measures that restrict access to these works are not allowed.
